THE MAIN POINT

A tourism opportunity needs planning compatibility, construction and operating evidence, and figures that withstand adverse scenarios.

01

The announcement is not a short stay permission

On 13 October 2026, Medellín's administration published an explanation about tourist accommodation and the proposed POT update. For a land buyer, the useful question is not whether tourism is good or bad in the abstract. It is whether the intended activity can lawfully be located and operated on the specific property. Public discussion sometimes mixes existing rules, proposed changes and obligations administered by different bodies. That confusion can lead to land being marketed using future earnings that have no verified regulatory foundation. Our approach separates four evidence folders: territorial planning rules, construction authorisation, tourism operating requirements and applicable private restrictions. One does not automatically replace another. This article considers the announcement with an information cutoff of 14 October 2026 and suggests a method for assessing opportunities. It does not claim that a new rule has been adopted or that any advertised parcel already has permission for a tourist accommodation business.

02

Define the activity you actually intend to operate

A house for personal use, a stable residential tenancy and accommodation offered to paying guests are not interchangeable descriptions. Before asking how a rule applies, write down how the project would operate: typical stay length, number of units, services provided, reception arrangements, cleaning, food preparation and shared facilities. That description enables a professional to ask focused questions of the relevant authorities. Calling something a holiday finca may conceal important operational differences. Consider two hypothetical projects using an identical building. A family occupies one for several years. In the other, new groups arrive every weekend, services are supplied and vehicles move frequently through the site. Their effects on the surrounding area and their regulatory assessment may differ. Recording the intended business model at the beginning reduces the risk of designing an attractive building that cannot support the actual activity the owner plans to carry out.

03

The municipal boundary is a decisive detail

Medellín, Envigado, Rionegro and Guarne have their own territorial planning instruments. A discussion about Medellín's POT does not establish compatibility for land in another municipality, even when an advertisement uses Medellín as its commercial reference point. Start with coordinates, the vereda or neighbourhood and the property's identifying records. Then establish the applicable instrument and the authority able to clarify the proposed use. Do not infer permission from a neighbouring accommodation business: its circumstances, history or possible noncompliance may be different. Nor should rural land be assumed to provide unrestricted freedom to install tourist cabins. Environmental constraints, access, water and wastewater arrangements may matter alongside the planning classification. We recommend requesting answers tied to both the identified property and the activity as described, while retaining application or enquiry references. An informal message without property identification leaves too many open questions to support a substantial purchase decision.

04

Tourism registration and planning checks do different jobs

The municipal communication highlights formalisation requirements for tourist accommodation. The practical lesson is that an operating registration should not be treated as a document resolving every issue concerning land use or construction. When evaluating an existing business, identify the establishment, its operator and the available records supporting its activities, then compare them with the property's own evidence file. Ask which requirements must be reconsidered if the operator changes, capacity increases or services are modified. We do not offer a universal list of procedures because the answer depends on the specific operation and rules in force. An adviser should establish which registrations and obligations actually apply. If a seller provides only a promotional screenshot or a reference to a booking platform, record it as commercial information rather than sufficient evidence of lawful operation. Supporting documents should be traceable to their official sources and matched to the business being assessed.

05

Neighbourhood compatibility is an operating commitment

Tourist accommodation creates patterns of movement that differ from those of a stable household. Late arrivals, access instructions, waste handling and outdoor activities need to be planned from the design stage. Where a property is subject to horizontal ownership arrangements, the relevant private documents and decisions must also be examined; a general authorisation should not be assumed to remove every restriction. Commercially, poor relations with the surrounding community can increase complaints, staff turnover and operational difficulties. Budget for reception or guest support, maintenance, cleaning, security and incident management according to the service promised. Establish how rules will be communicated to guests and who will respond when those rules are not followed. A quality tourism experience provides rest for visitors while respecting the people who live nearby. An assessment focused only on the number of beds conceals an important part of the project's feasibility and continuing management workload.

06

Model income with occupancy, costs and downtime

Gross revenue shown in a presentation is not the cash available to pay for land. Allow for unoccupied periods, cleaning between stays, maintenance, sales channels, utilities and operator expenses. Use explicit scenarios and retain the source of every assumption. If comparable accommodation is used, record differences in location, capacity and services; a publicly displayed availability calendar does not by itself prove a paid reservation. In a hypothetical example, high prices on selected weekends can coexist with modest annual earnings when vacancy is substantial and fixed costs remain significant. A downside scenario should test how long the business could operate without unexpected owner contributions rather than advertise a return. A projection does not replace a lender's written quote or a professional market study. Avoid funding the purchase on the assumption that full occupancy will begin immediately or that administrative procedures cannot delay the opening of the business.

07

Uncertainty should be visible in the negotiation

When a purchase depends on tourist use, that dependency should be addressed before significant binding commitments are signed. Prepare a list of missing documents and unresolved questions affecting the outcome, then ask a lawyer to structure negotiations around those risks. The professional must consider timing, conditions, payments and consequences if the necessary answer is negative. Copying a generic internet clause is not enough. If the seller says everything is permitted, request specific supporting evidence and check that it concerns this property and this operation. An older approval may require reconsideration when the project changes, while a proposed rule may ultimately be adopted with different wording. Transparency protects both parties: buyers understand what they are assessing and owners avoid promising characteristics they cannot substantiate. Pausing a negotiation because essential information is missing can be a better commercial decision than attempting to resolve the same uncertainty after closing.

08

What to do after reading the announcement

A useful response to this announcement is to update the evidence file rather than immediately reprice every parcel. Save the dated communication, distinguish statements describing existing obligations from statements about the proposed revision, and consult the applicable text when evaluating an actual operation. An owner preparing to sell can create a property brief separating confirmed use, pending enquiries and commercial possibilities still requiring study. A buyer can compare at least one alternative that does not depend on short stays, making the project's concentration of risk easier to recognise. Follow up by checking adopted acts and relevant official instructions. Our analysis supports tourism that fits its setting and projects supported by evidence. It does not certify compliance for any establishment, guarantee earnings or transform a commercial label used in a property advertisement into a legally recognised classification of the underlying land.

Four folders before modelling short stays

The municipal explanation dated 13 October 2026 is the starting point rather than individual approval. Keep the four folders separate and do not populate an income model with assumed permissions.

1. Territorial planningPrecise location and applicable current text; retain proposed POT wording separately.Municipal planning: ask about the activity described rather than a tourism label alone.
2. Construction and physical statusProject, construction background and documents the professional identifies as relevant.Technical review and competent authority: clarify the relevant procedure before alteration or construction.
3. Tourism operationOperating model and registration requirements to enquire about for that operator.Consult official MinCIT information; tourism registration alone does not answer planning questions.
