Buying from abroad: property, investment and foreign-exchange records

How to coordinate a property acquisition with the source of funds and the foreign-exchange steps applicable to the investor.

THE MAIN POINT

Property registration and investment registration answer different questions; organise both before transferring funds.

01

Classify the investor before the transfer

Purchasing from another country is insufficient to classify the transaction. Ask the adviser to establish the acquiring person, their residence for exchange purposes, source of funds and actual structure of the deal. Nationality, account location, tax residence and immigration status should not be treated as synonyms. A Colombian citizen living abroad and a foreign citizen established in Colombia may require assessments different from those suggested by their passports. Banco de la República describes direct foreign investment by reference to nonresident status and assets including real estate within the applicable framework. Do not infer a definitive classification from a conversation with a property intermediary. Assemble the necessary facts and records and obtain a written explanation of the applicable route. Also establish whether the purchaser is an individual, company or fiduciary structure. The choice should reflect the project and legal and tax assessment rather than merely the convenience of sending money from an existing account. Correct classification makes later reporting and payment instructions easier to reconcile.

02

Distinguish ownership from investment records

The property folio records the land's legal history; exchange information documents investment under a separate framework. An investment extract does not certify that the seller has sufficient title or replace the deed and registered acquisition. Conversely, acquiring the property does not automatically settle every obligation connected with international funds. Prepare two linked lists: property documents and records concerning the investor and money movements. Use consistent identity and concepts in both, explaining differences where appropriate. The property list should address holders, burdens, access and local conditions. The exchange list should identify responsibility, information to be supplied and evidence to retain. If someone offers to register everything, ask which registry, through what action and with what proof. A broad commercial expression may conceal that only the deed or only the bank transfer is being arranged. The buyer needs to understand each professional's contracted scope. Connecting both lists also allows errors to be identified before they spread across instruments and reporting systems.

03

Prepare the payment channel and information

Before sending funds, explain the transaction to the exchange-market intermediary or relevant adviser and confirm current requirements. Banco de la República's guidance distinguishes investments involving channelled foreign currency, where supplying the required information can produce automatic registration, from other operations using an investment registration declaration in the Exchange Information System. The second route does not itself remedy a failure where channelling was mandatory. Choosing the banking concept only after transferring is therefore unwise. Verify the holder, recipient, identification and contractual connection; document contributions from several people and staged payments without inventing a single economic operation that did not occur. Obtain current quotations explaining commissions, effective exchange rate and amount received. If using another mechanism, require assessment of its treatment and traceability. A convenient application or a transfer accepted by a bank does not itself establish correct classification and reporting. Confirm instructions before release and keep the evidence needed to explain the payment within the wider purchase sequence.

04

Keep records that can be reconciled

Keep contracts, transfer records, information supplied through the payment channel, acquisition instruments and applicable investment evidence. Prepare a table connecting date, currency, amount, holder, recipient and concept, distinguishing amounts sent from amounts received. If a passport, identification or actor details change, consult the current update procedure before creating duplicate records. The Exchange Information System instructions explain enquiries, extracts and adjustment processes; using the system requires understanding the capacity in which each person acts. Do not share passwords or verification codes with an intermediary to avoid arranging representation. If an attorney participates, document authority and the applicable mechanism. Preserve quotations and agreements addressing exchange differences to explain the price paid. The file should allow the property transaction and funds movement to be reconciled without relying on a single screenshot or the memory of the person who sent the money. Give the appointed adviser the relevant records through a controlled channel and keep an inventory of documents supplied and outstanding.

05

Organise remote purchase and understanding of the contract

When buying without attending personally, separate viewing, advice, representation and document custody. Someone filming the land does not necessarily investigate title, and an attorney authorised to sign may lack authority to receive money or change the price. Obtain review of the power and formalities according to where it is executed. Before signing, ensure understanding of the deed, attachments and conditions; a notarial interpreter may be appropriate where the participant does not know Spanish sufficiently. Request viewing evidence identifying the property and its limitations, including access and utilities. Keep decisions in writing and establish confirmation procedures for material payment changes. Distance does not remove the need to verify the actual property. If travel dates constrain the purchase, reflect that reality in negotiations without assuming the registry office or lender will adjust decisions to a flight. A remote transaction needs a reliable chain of instructions and evidence extending through registration and physical handover rather than ending when an authorised representative signs.

06

Example: funds arrive from a relative’s account

A nonresident purchaser agrees to acquire a lot in their own name, but a relative sends part of the price from another account to accommodate travel plans. The seller receives the money and everyone assumes the issue is resolved. Later, the adviser needs to explain who invested, the legal relationship between relative and purchaser, and how the movement was reported. The answer should not be invented by changing a description on a private spreadsheet. Instructions, source, documents and available adjustments require review with the competent professionals and institutions. If the relative is actually lending or contributing funds, that relationship also requires assessment. This hypothetical example does not claim that all third-party payments are prohibited or that every record can be corrected identically. It demonstrates why the structure should be documented before money moves. Coordinating investor, acquirer and remitter prevents a simple family contribution from creating inconsistencies difficult to explain on a later sale or during review of the investment history.

07

Review immigration and taxation separately

The purchase should not be advertised as automatic permission to reside, work or conduct an activity. If an immigration purpose is essential, check current requirements with the relevant authority and obtain assessment of your circumstances rather than relying on old investment figures or promotional timelines. Banco de la República explains obtaining an investment extract that may support a visa procedure, but that evidence is not immigration approval. Likewise, exchange registration does not itself determine tax residence, acquisition taxes, income taxation or disposal taxes. Obtain a map of obligations in Colombia and the relevant other country, with dates and responsibilities established by a professional. Separate price, currency conversion, transaction costs and maintenance in the budget; do not describe tax savings or returns as guaranteed. The acquisition structure should remain understandable if personal plans change. Record which questions belong to each regime so a partial answer is not presented as a complete solution. Specialist reviews should use consistent facts even though their legal classifications may differ.

08

Plan disposal, changes and ongoing review

Before investing, ask how a future sale, substitution or cancellation will be documented and what records should be retained. Official instructions distinguish those events and actions in the Exchange Information System. Review the rules current when the event occurs: Decree 1044 was published in 2026 amending the provision concerning deadlines for certain changes and cancellations; this guide does not state a universal deadline. A change of residence also deserves specific consultation rather than assuming a passport always produces the same classification. At purchase completion, verify registered acquisition and applicable exchange evidence, retaining outstanding items for each process. This guide received editorial review on 14 October 2026; the official general information and instructions consulted show August 2026 updates. The adviser should check current operational rules and actual circumstances before funds are transferred, corrections made or proceeds remitted. Today's traceability makes the investment's origin and eventual disposal easier to explain. Revisit the file when the investor, property or payment arrangement changes materially.

Question route for funds from abroad

Complete this worksheet before ordering transfers. Passport, exchange residence and immigration permission answer different questions. The table prepares an enquiry about the actual transaction without classifying the investor or registering funds.
