THE MAIN POINT

Compare outcomes and responsibilities for each alternative rather than treat advertised rent or expected appreciation as guaranteed income.

01

Define what you want to achieve and when

Write why selling or leasing is being considered: needing funds, retaining land, enabling temporary use or reducing tasks. Our editorial comparison starts with that objective because the alternatives produce different outcomes. The Civil Code regulates sale and lease as distinct relationships; request case specific legal review before preference becomes commitment. Retained ownership does not eliminate every responsibility, and sale should not be assumed to resolve every outstanding matter. Record horizon, management capacity and relevant personal circumstances for professional consultation. Where several owners exist, establish who must participate and which agreements need review. The initial goal is identifying options worth investigating rather than maximising one figure. An alternative may look attractive through potential income yet conflict with the time available for management or a future use the owner wants to preserve for the particular property.

02

Clarify what can be offered and missing background

Organise identification of the property, right and powers of the negotiating person. Law 1579 describes folio information and registered acts; the adviser should connect it to the proposed alternative. Our record avoids advertising the entire parcel where the offer actually concerns a portion or right with different conditions. Record occupations, installations and features affecting handover or use without drawing legal conclusions from appearances. Request professional explanation of missing background before promising immediate availability. A dossier can identify available and outstanding evidence without routinely publishing complete documents. For leasing a zone, define shared spaces and services; for selling, identify accompanying elements. Clear object definition supports comparison of real alternatives. Otherwise estimated rent and sale price may concern different things, producing an apparently mathematical decision that does not represent the same land or commercial scope offered to interested parties.

03

Compare available funds and cash flows with assumptions

Prepare separate sale and lease scenarios using documented or pending figures. Our editorial sheet distinguishes asking price, quoted expense, potential income and funds actually available under conditions requiring review. It invents no market rents, taxes, rates or returns. Ask relevant tax and legal advisers to identify particular costs and duties before calculating net outcomes. For rent, consider unoccupied periods and expenses potentially borne by the owner as scenarios rather than universal percentages. For sale, distinguish the advertised offer from a completed transaction. Future proceeds may not meet an immediate cash need, while periodic income cannot guarantee continuity. The purpose is understanding assumptions making each alternative work and evidence capable of changing the decision. If a scenario requires permanent occupancy or an optimistic future price, expose that dependency rather than present it as an assured result from the property.

04

Use price evidence with purpose and date

Organise commercial references without treating them as verified transactions and commission professional valuation where relevant. Law 1673 regulates appraisal activity and registration; confirm relevant scope and professional status. Our comparison separates your expected price, offers received and commissioned opinion rather than calling an informal impression an appraisal. Rent for another property may involve different terms, uses and duties; do not transfer it automatically. Distinguish physical or documentary changes requiring review before reusing an old figure as well. If an expectation depends on a future project, first examine evidence supporting that use rather than value it as an acquired right through desire. The goal is not a reference confirming the preferred option but understanding which figure informs each decision and where support is missing, enabling negotiation through verifiable facts rather than promises of income or appreciation nobody established.

05

Examine management retained through leasing

Describe actual tasks: counterparty selection, communication, review of proposed use, attendance to needs and document follow up. The Civil Code regulates lease duties requiring connection to the contract and relevant rules; do not allocate responsibility through habit alone. Our record asks who can manage, what assignment is needed and its cost under a concrete proposal. If living elsewhere, assess local coordination without ambiguous powers or assuming a relative will handle everything free. Consider information to be received and how decisions are recorded as well. Rent may preserve the property but needs operation fitting your capacity. Do not enter unknown management as zero merely to favour leasing. An honest decision may recognise viable supported administration or a commitment incompatible with the objective even where potential income looks attractive on paper for the particular proposed use.

06

Review future use and treatment of investment

If retaining the land for another project, explain that horizon to the lawyer before negotiating term and conditions. Law 388's national planning framework supports review of use with the competent jurisdiction; a private contract cannot replace that assessment. Our editorial proposal asks which activities and works are envisaged, who finances them and what treatment their completion needs. Do not assume a removable home eliminates every discussion about improvements, removal or return. Have the technical team define scope and the lawyer explain applicable options rather than inventing a universal right. For sale, consider which later expectations actually remain and which would require reviewed agreement if relevant. The phase compares control, future availability and commitments instead of reducing the choice to income. An attractive figure cannot by itself resolve an alternative contradicting the owner's essential purpose for the land.

07

Test attractive rent requiring works

Imagine an owner wishing to retain land and receiving a lease proposal for a home installation. Attractive rent is offered, but the prospect needs a long term, works and transport access. Our review separates potential income, compatible use, investment and exit without automatically favouring sale or lease. Request background and advice explaining commitments the proposal requires. If the owner intends personal use soon, the horizon may conflict despite appealing income. If another timetable is acceptable, conditions can be investigated through evidence. Compare that option with sale using reviewed costs and expectations without inventing current prices. The case shows how a concrete offer changes a decision by revealing responsibilities absent from an initial comparison. Neither fear based rejection nor enthusiastic acceptance is necessary; understand the outcome each party obtains and the dependencies remaining under the proposed arrangement.

08

Keep a reviewable decision with identified facts

Close comparison with the objective, alternatives, documents, supported figures and outstanding questions. Our final record states why an option is preferred and what could change it, distinguishing personal preference from professional conclusion. In advertising, describe the actual object and conditions without promising unverified returns or availability. In negotiations, ask the lawyer to turn relevant agreements into appropriate documents and explain circumstances to financial or tax advisers. Not every eventuality needs solving to reject an incompatible alternative, but a dependency determining the outcome deserves review. Update the decision when the purpose changes or a materially different offer appears. Selling or leasing has no universal answer for every parcel. A defensible choice connects funds, management and desired future with its own evidence while exposing tasks needed before the next commitment and identifying who should handle them for the particular transaction.

Sell or lease: first-year cash in a fictional case

Invented amounts in millions of COP: sale 200, selling expenses 10, monthly rent 2, owner’s annual expenses 4 and initial lease preparation 8. Additional taxes, finance and appreciation excluded; replace every figure with case-specific information.

Scenario or controlHypothetical saleHypothetical lease
Initial available capital200 − 10 = partial net 190 if everything is paid at the assumed closing. Deferred terms change the timetable. The property price is not received. Initial preparation expenditure is 8 under the assumption.
First year with 10 occupied monthsThe 190 is not recurring income. Keep subsequent use of the proceeds separate.2 × 10 = gross 20; 20 − 4 − 8 = partial cash 8 in the first year.
Sensitivity: only 8 occupied monthsIf no buyer arrives, receipt does not occur on the assumed date; model waiting and expenses separately.2 × 8 − 4 − 8 = partial cash 4. Do not treat 12 months of rent as guaranteed receipts.
Asset and exit at year-endIn the sale assumption the land is no longer retained; do not count its price again as an owned asset. The asset is retained under the agreed arrangement, but future price, liquidity and exit expenses still need assessment.
Decision and next toolCompare receipt timing and certainty against liquidity needs; review the actual proposal and expenses with advisers.Take rent, vacancy and expenses to the rental return tool; review the contract, improvements and management before choosing.
