Paying an obligation, lifting a measure and cancelling its registration are separate results that require coordination and verification.
Identify the entry precisely
Start with the complete, recent property certificate, including entries cancelling earlier instruments. A mortgage secures an obligation; an attachment is a measure whose origin and effects require investigation; registration of a lawsuit serves a different procedural function. Do not group them all under the label of property debts. Record the entry number, date, instrument, creditor or authority, relevant people and cancellation references in a matrix. Obtain the complete underlying instruments because the certificate usually summarises their contents. Check whether the burden affects the entire property, one share or several folios, and whether the seller is the person entitled to dispose of the right. The analysis should distinguish current entries from cancelled ones while preserving the history. An old burden may have been properly cancelled, whereas a recent entry may need immediate attention. Professional review should explain what prevents or conditions the proposed transaction and identify the specific evidence needed to address each issue, rather than relying on the seller's general assurance that everything will be cleared.
Read what the mortgage secures
The Civil Code requires a public deed and registration for a mortgage and allows the mortgaged property to remain with its owner. The security does not itself mean the owner has lost ownership or that sale is impossible; equally, it does not mean a purchaser receives the land free of that security. Review the mortgage deed and obligation documents with an adviser. Identify the current creditor, secured obligations, affected folios and conditions for releasing the property. A figure appearing in the certificate should not automatically be treated as the final outstanding balance. The security may have conditions whose scope requires further documents. If the seller proposes paying the creditor from the purchase price, obtain current information verified through independent channels. Ask whether release is complete or partial and which instrument establishes it. The civil ability to sell mortgaged land does not replace the buyer's commercial decision about accepting security that might continue to affect the acquired property. Make that decision explicit before agreeing the payment structure.
Investigate the authority and attachment proceedings
When an attachment appears, identify the court or authority, case number and instrument ordering the measure. Article 1521 of the Civil Code contains a rule concerning disposal of attached assets and its exceptions, which must be applied to the actual transaction after review. Do not assume a private creditor letter enables registration of any sale: establish the documentary and registration route before closing. Articles 593 onwards of the General Code of Procedure regulate judicial measures, whereas administrative action may follow different rules. Ask whether other measures, custody arrangements, residual attachments or proceedings need consideration, and obtain an explanation of the current position through an authorised channel. An email from the seller saying the case has been archived does not replace the relevant orders. If payment is intended to secure lifting, identify the applicant, decision-maker and method for transmitting the order to the registry. Avoid committing to a purchase date based solely on an expectation that the judge will sign soon. The necessary steps should be individually evidenced and assigned to responsible people.
Distinguish clearance, instrument and cancellation
A clearance certificate may report payment of an obligation, but establish its effect and the remaining steps needed to cancel the security. Articles 61 and 62 of Law 1579 address cancellation of a registration entry using the appropriate supporting instrument or competent order. A mortgaged-property closing therefore needs a sequence connecting payment, cancellation instrument, filing and the resulting folio entry. For an attachment, identify the order lifting the measure and registration of its cancellation, together with any relevant procedural requirement. Ask the lawyer to check that cancellation refers to the correct entry and folio. Where several creditors or burdens exist, one release does not necessarily resolve the others. Keep complete payment records and acknowledgements that make the process traceable. Compare the seller's statement that the land will be free of burdens with the documentary result agreed for the transaction. The notary, creditor, judicial authority and registry office perform distinct functions along this route. Evidence that one participant has finished does not establish completion of every remaining step.
Design the money flow around evidence
Before transferring funds, prepare a schedule showing recipient, purpose, payment condition, evidence and remaining purchase price. If part goes to the creditor, verify identity, account ownership and authority to receive it; changes to instructions require confirmation through a previously verified channel. Obtain advice on available mechanisms for coordinating obligations and avoiding release without the agreed result. Intermediaries do not all offer the same service or accept responsibility for discharging a burden. The agreement should explain how the payment counts towards the price, responsibility for balance differences and consequences if cancellation is delayed or registration is rejected. Consider the documents supporting a claim, rather than maintaining only a spreadsheet of transfers. Any negotiated retention needs clear drafting of its purpose, conditions and administration; no universal percentage suits every transaction. The purchaser should understand when money leaves their control and what right or evidence they receive at each stage. Confirm that proposed arrangements are actually available and accepted by the institutions involved before incorporating them into a binding timetable.
Example: paying the bank leaves a separate attachment unresolved
Imagine a farm subject to a bank mortgage and a judicial attachment securing a separate obligation. The seller calculates the bank balance and proposes direct payment by the buyer, promising that everything will then be resolved. The entry matrix shows two creditors and two independent processes. The lawyer requests the mortgage cancellation information and separately examines the attachment proceedings and available lifting route. The buyer also discovers that the bank's letter releases only one of the two folios included in the offer. Documents, price and conditions require adjustment; paying the amount initially quoted would not produce the intended result. If resources or cooperation are unavailable to resolve all relevant burdens, postponing or declining the transaction may be necessary. This hypothetical example illustrates why each payment and instrument should connect to a specific entry. A message saying debt-free does not establish what has been paid, released or registered. The purchaser needs a complete closing route covering every property and every burden material to the acquisition.
Monitor changes between review and registration
A certificate reviewed during negotiation captures one moment; it does not reserve the property. Agree updated checks near critical stages and a channel for reporting changes. Law 1579 establishes priority and qualification principles, and filing instruments does not guarantee that all will be registered. Arrange tracking of filing numbers and any rejection notice, assigning responsibility for appropriate corrections. If a new measure or incompatible instrument appears, pause the dependent step and obtain assessment of its actual effect under the agreement and law. Do not address the issue by silently changing a contract date or using an older certificate. Document consequences for payment release, possession and the closing timetable. Where several instruments are intended to operate together, the lawyer should examine their sequence and relationship with creditors and registration. The objective is to establish the actual result, rather than merely secure everyone's signature on the same day. Preserve verifiable communications explaining why a particular payment occurred or a stage was suspended, especially when institutions are working to different schedules.
Define completion free of the identified burdens
The closing report should list the reviewed entries, cancellation instruments and registration result obtained. Verify both the intended acquisition and the relevant cancellations; a signed deed alone does not answer both questions. If a burden is expressly accepted, the purchaser needs to understand its scope and reflect it accurately in the agreement with independent advice. File certificates, instruments, receipts, orders and registration acknowledgements in a sequence another professional can review. When advertising a later sale, use descriptions supported by current information rather than calling land free of every burden because of an old conversation. This guide received editorial review on 14 October 2026 and explains national criteria for civil security and judicial measures. It does not determine balances or approve a particular disposal. Administrative recovery, insolvency and other restrictions depend on their own framework and should be added to the investigation whenever the certificate or underlying history indicates their relevance. The final decision should reflect the actual recorded position and outstanding obligations at the time of the proposed transaction.
Sequence for two separate burdens
As a hypothetical example, imagine a folio showing a mortgage and a separate attachment. Complete a sequence for each burden with your adviser: paying an obligation and cancelling an entry require separate evidence.
| Review question | Evidence to record | Next action |
|---|---|---|
| Which entry corresponds to each burden? | Entry number, instrument, creditor or authority, affected property or share and related documents. | Create two tracking records; do not combine the mortgage and attachment as one debt. |
| What is the obligation and verified balance? | Dated creditor response, identified obligation, payment instructions and scope of any clearance statement. | Confirm recipient and purpose; do not use a historical certificate amount as the settlement balance. |
| Which instrument cancels the mortgage? | Proposed instrument, signatory authority and connection to the folio and mortgage entry. | Coordinate execution, filing and registry verification; payment evidence does not complete the whole sequence. |
| Which decision lifts the attachment? | Authority, case, order, conditions and route for communicating the decision to the registry. | Check procedural and documentary scope; a creditor letter does not itself replace the competent action. |
| Did the outcome release both entries? | Updated certificate and cancellation instruments compared with both initial tracking records. | Record each outcome and other outstanding burdens before closing; one release does not establish the other. |
